Understanding the option agreement
What Is an Option Agreement?
An option agreement is a legal contract between a landowner and a land promoter. It gives the promoter the exclusive right to apply for planning permission on the landowner's land during a defined period — typically two years. The landowner retains full ownership of the land throughout. If planning is granted and the land is sold, the proceeds are shared between the landowner and the promoter according to the agreed terms. If planning is not granted, the option simply expires and the landowner is free to do as they wish with their land.
